Fighting Racial Discrimination in the Workplace

Discrimination in our nation still exists. However, there are laws that would protect people from inequity be it in work place, at school, or just about anywhere.

People are often discriminated because of their gender, sexual preference, age, religion, ethnicity, and race.

The government has long been fighting discrimination be it on workplace or not. In fact, it is covered under Title VII of Civil Rights Act of 1964.

Racial discrimination is one of the most common manifestations of inequality. Some people are judged because of their color and not of what their actions are.

Racial Discrimination at Work Place

Workplace is where people come together to attain a common goal. Interaction among workers or between employees and their employers can sometimes lead to discrimination of an individual.

It is against the law to discriminate anyone especially inside the work place. Employers must not base their actions on a person’s gender, sexual preference, age, religion, ethnicity, and race.

According to a statistical data issued by the Equal Employment Opportunity Commission (EEOC) in 2006, out of the 75, 768 charges that has been filed, more than one-third or roughly 27, 328 of these charges is related to racial discrimination.

Here are some common expressions of discrimination in a workplace:

  • Termination of contract based on a person’s gender, sexual preference, age, religion, ethnicity, and race
  • Disqualification for a promotion / benefits because of his gender, sexual preference, age, religion, ethnicity, and race.
  • Racial / sexual harassment
  • Uneven distribution of work among workers of the same position
  • Calling a person names aside from his because of his gender, sexual preference, age, religion, ethnicity, and race.
  • Racist remarks against an employee
  • The person is the subject of racist jokes or comments

Based on a data released by the United States Department of Labor, black Americans has the highest percentage of unemployment in November 2007 with an average of 8.4%.

Everyone must have equal chance of getting a promotion and/or other benefits. Same goes with job application. Every applicant must have equal chances of getting the job and not be discriminated.

Things a Worker can do to stop Discrimination

If a person experiences any kind of discrimination, he can:

  • A person can file a charge against his employers or co-employee’s discriminatory acts or remarks.
  • If a case is filed, the employee cannot terminate the employment of the person involved especially if the case is against him.
  • Take note of the date or time of the racist act
  • If possible, have witnesses that can account for your accusations
  • Hire a good legal representation.

There are employers who take advantage of people that they hire. Some would scare an employee with their contract.

These employers are aware that because a worker is afraid to lose his job and thus, be afraid of telling anyone of their ordeal. This belief should be abolished.

The employer cannot terminate the person’s employment solely on the grounds of his charge against the employer.
